SEVEN: TERMS OF SERVICE

These Terms of Service govern your use of Seven, a hosted task and work management application available at seventasks.net. By creating an account, accepting an invitation, or using Seven, you agree to these terms. If you do not agree, do not use Seven.

Where you are using Seven on behalf of an organisation under a signed End User Service Agreement, that agreement applies to your organisation's use and prevails over these terms to the extent of any inconsistency.

1. Who we are

Seven is operated by Gregory Thomas Dobson trading as Seven, ABN 77 474 138 379, of 18 King Albert Avenue, Tanilba Bay NSW 2319. In these terms, "Seven", "we", "us" and "our" refer to that business, and "you" and "your" refer to you as the account holder.

2. Eligibility and your account

2.1 You must be at least 16 years of age to hold an account.

2.2 You must provide accurate registration details and keep them current.

2.3 Your account is personal to you. You must not share your login credentials, and each person using Seven needs their own account.

2.4 You are responsible for activity that occurs under your account. Tell us promptly at support@seventasks.net if you believe your account has been accessed without your authorisation.

2.5 You can create an account through self-service registration, which requires a verified email address, or by accepting an invitation from an existing Seven team.

3. Your subscription

3.1 The available plans are:

3.2 Prices are in Australian dollars and exclude GST unless stated otherwise. GST will be added where it applies.

3.3 Subscriptions are billed in advance and renew automatically at the end of each billing period until you cancel.

3.4 Payments are handled by our payment provider. We never see or store your card details.

3.5 We may change our prices on at least 30 days' notice. A new price applies from your next renewal after that notice, and you can cancel before then if you do not want to continue at the new price.

3.6 Every plan starts with a 7-day free trial. You provide card details when you sign up, and the first charge is made automatically when the trial ends unless you cancel before then. You can cancel during the trial from the billing portal and you will not be charged. One free trial is available per customer.

4. Cancellation and refunds

4.1 You can cancel at any time from your account settings. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then.

4.2 We do not provide pro-rata refunds for the unused part of a billing period, except where a refund is required by law.

4.3 Nothing in this section affects your rights under the Australian Consumer Law. If Seven has a major failure, you may be entitled to a refund or other remedy under that law regardless of what this section says.

4.4 If we discontinue Seven, or terminate your account other than for your breach of these terms, we will refund the unused portion of any fees you have paid in advance.

5. How you may use Seven

5.1 We grant you a personal, non-exclusive, non-transferable right to use Seven for your own work, business, study or research purposes while your subscription is active.

5.2 You must not:

  • copy, modify, reverse engineer or attempt to extract the source code or underlying design of Seven, except where the law permits it;
  • scrape, harvest or bulk-extract data other than through Seven's own export functions or an interface we have authorised;
  • use Seven to build or assist in building a competing product;
  • resell or sublicense access to Seven without our written agreement;
  • get around login requirements, seat limits, rate limits or other technical controls; or
  • use Seven to store or send anything unlawful, defamatory, harassing, discriminatory or infringing, or to introduce malicious code or interfere with the service for anyone else.

5.3 We may apply rate limits and monitor for abusive access patterns. If we suspect misuse, we may suspend your account while we investigate, and we will tell you why unless the law prevents us.

6. Your content

6.1 You own the content you put into Seven. We do not claim any ownership of it.

6.2 You give us permission to store, transmit, display and back up your content to the extent we need to in order to run the service, support you, and comply with the law.

6.3 We do not sell your content, and we do not use it to train machine learning models.

6.4 We will not access your content except where it is reasonably necessary to run or fix the service, to give you support you have asked for, to investigate a suspected breach of these terms or a security incident, or where the law requires it.

6.5 You are responsible for the content you add. If you record information about other people (a client's name and email in a contact record, for example), you are responsible for having collected it lawfully and for handling it in line with your own privacy obligations. Do not upload sensitive information, health records, government identifier numbers or payment card data to Seven.

6.6 You should keep your own copies of anything you cannot afford to lose. Export functions are available in the application at any time.

7. Privacy

Our Privacy Policy explains what personal information we collect, how we use it, who we share it with and where it is stored. It forms part of these terms. Note in particular that Seven's servers are located outside Australia; the Privacy Policy sets out the detail.

8. Availability

8.1 We aim to keep Seven running and available, but we do not guarantee any particular level of uptime under these terms.

8.2 We may take Seven offline for maintenance. We will try to schedule it outside Australian Eastern business hours and to give you notice, but urgent maintenance may happen without warning.

8.3 Support is by email to support@seventasks.net during Australian Eastern business hours. We aim to respond within two business days.

9. Changes to Seven and to these terms

9.1 We may add, change or remove features. If a change materially reduces something you rely on, we will try to give you notice first.

9.2 We may update these terms on 30 days' notice, given by email or in the application. If a change materially disadvantages you, you may cancel before it takes effect and we will refund the unused part of what you have paid. Continuing to use Seven after the effective date means you accept the updated terms.

10. Ending your account

10.1 You may stop using Seven and cancel at any time, as described in section 4.

10.2 We may suspend or close your account if you materially breach these terms and do not fix the breach within 14 days of us telling you about it, or immediately if your use is unlawful or presents a security risk.

10.3 After your account is closed, we keep your data for 30 days so you can export it, then delete it from our live systems. Copies may remain in backups for up to a further 90 days before they are overwritten.

11. Our liability

11.1 Your rights under Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have at law that cannot be excluded. Where the law allows us to limit our liability for breach of a consumer guarantee, our liability is limited to resupplying the services or paying the cost of having them resupplied.

11.2 Subject to section 11.1, our total liability to you for anything connected with Seven is limited to the greater of the fees you paid us in the 12 months before the event that gave rise to the claim, or one hundred dollars ($100).

11.3 Subject to section 11.1, we are not liable for lost profits, lost revenue, lost data, lost business opportunities, or any indirect or consequential loss.

11.4 Seven is a productivity tool. Its scheduling, planning and reporting outputs are aids to your own judgement, not professional advice, and should not be the sole basis for a decision with financial, legal, regulatory or safety consequences.

12. Disputes

If something goes wrong, contact us first at support@seventasks.net and tell us what the problem is and what outcome you are looking for. We will attempt in good faith to resolve it with you within 21 days before either of us starts formal proceedings. This does not prevent either of us from seeking urgent relief from a court.

13. General

13.1 These terms are governed by the laws of New South Wales, Australia.

13.2 If any part of these terms is found to be invalid, that part is severed and the rest continues to apply.

13.3 We may transfer these terms to a successor of the business operating Seven, on 30 days' notice to you.

13.4 These terms, together with our Privacy Policy, form the whole agreement between us about your use of Seven.
